2. Scope of Educational Hosting & Contributor Obligations
DPGNotes is dedicated to fostering academic collaboration and accessibility. Under our platform terms, registered student contributors explicitly warrant and represent that:
- All uploaded lecture notes, study materials, and practical solutions represent their own original analysis, commentary, or legitimate classroom syntheses created independently.
- No whole commercial textbooks, copyrighted publisher question test-banks, proprietary institutional software code, or unauthorized examination keys are published on the platform.
- Any brief excerpts included from academic sources constitute non-infringing educational fair use under Section 52 of the Indian Copyright Act 1957 and 17 U.S.C. § 107, credited with appropriate citations.
Notwithstanding contributor warranties, DPGNotes respects the legitimate proprietary rights of authors, publishing houses, faculty members, and academic institutions worldwide, and acts decisively upon notice of infringement.
3. Mandatory Requirements for a Valid DMCA Notice
To establish legal validity under 17 U.S.C. § 512(c)(3), an infringement notification must be provided in writing to our Designated Agent and contain substantially the following items:
- Physical or Electronic Signature: A physical or digital signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the Copyrighted Work: Precise description and identification of the original copyrighted work claimed to have been infringed, or if multiple works at a single site are covered, a representative catalog of such works.
- Identification of Infringing Material: Clear identification of the specific file, note, or document alleged to be infringing, accompanied by direct, verifiable URLs on DPGNotes (e.g.,
https://dpgnotes.web.app/dpgnotes-pdf-viewer.html?docId=...) or unique resource identifiers. - Contact Information of the Claimant: Sufficiently detailed contact data allowing our compliance team to communicate with you, including legal name, organization, mailing address, telephone number, and official email address.
- Good Faith Statement: A formal statement that: "I have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law."
- Penalty of Perjury Certification: A formal certification statement that: "The information in this notification is accurate, and under penalty of perjury, that I am the owner, or authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed."
4. Takedown Protocol & Content Quarantine Procedure
Upon receiving an actionable DMCA notice compliant with statutory standards, DPGNotes adheres to the following workflow:
- Immediate Acknowledgment: Our compliance team acknowledges receipt within 24 hours and issues a unique Case Tracking Token.
- Material Quarantine: The contested resource is immediately deactivated and removed from public access, indexing feeds, and search caches within 48 business hours.
- Contributor Notification: The contributor who uploaded the material is promptly alerted via registered email with a copy of the notice (redacted of personal claimant data if legally permitted) and instructed on their statutory counter-notification rights.
5. Contributor Counter-Notification & Dispute Redressal
If a student contributor believes in good faith that their material was removed or disabled as a result of mistake, misidentification, or legitimate fair use, they may submit a formal Counter-Notification pursuant to 17 U.S.C. § 512(g)(2)-(3).
A legally sufficient Counter-Notification must include:
- The contributor's physical or electronic signature.
- Identification of the material that has been removed or disabled, and the location/URL at which it previously appeared.
- A statement under penalty of perjury: "I declare under penalty of perjury that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled."
- The contributor's full legal name, permanent address, telephone number, and student identity credentials.
- Consent to the jurisdiction of the competent court of law for the judicial district in which the user is located, or if outside the United States, to any judicial jurisdiction where DPGNotes may be found, and agreement to accept service of process from the original claimant.
Upon receiving a valid Counter-Notification, DPGNotes forwards a duplicate copy to the original complaining party. If the claimant does not notify DPGNotes within 10 to 14 business days that they have filed a court action seeking to restrain the contributor from engaging in the infringing activity, DPGNotes is statutorily authorized to restore the removed content.
6. Repeat Infringer Policy & Account Sanctions
In accordance with 17 U.S.C. § 512(i)(1)(A) and our DRASA regulations, DPGNotes enforces a transparent Three-Strike Policy for contributors:
- Strike 1 (Informational Warning): Removal of the disputed material, educational advisory on academic integrity, and mandatory acknowledgment of copyright policies.
- Strike 2 (Temporary Restriction): Removal of disputed content, 30-day suspension of publishing permissions, and review of all prior submissions.
- Strike 3 (Permanent Termination): Immediate revocation of account access, permanent deletion of author profile, and referral of systemic abuse to institutional authorities.
7. Misrepresentation & Fraudulent Claims (17 U.S.C. § 512(f))
Claimants should be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be held liable for statutory damages, including court costs and attorney's fees incurred by the alleged infringer or by DPGNotes. DPGNotes reserves the right to pursue civil remedies against bad-faith notices designed to stifle legitimate educational discourse.
